Description of Case: Plaintiff, a 43-year-old male, was injured in an automobile accident. Plaintiff initially filed suit against the Defendant tortfeasor on January 27, 2000. After negotiations, Maryland Automobile Insurance Fund paid its policy limits of $20,000.00. On March 13, 2000, Plaintiff filed suit against The Cincinnati Insurance Company and then on April 30, 2001 against Hartford Fire Insurance Company. Defendant Cincinnati Insurance eventually settled for policy limits of $100,000.00, less the $20,000.00 paid by Defendant.
Plaintiffs demanded arbitration pursuant to the Hartford policy. At the three-panel arbitration hearing, Defendant’s examining doctor admitted Plaintiff’s injuries were causally related to the collision. Following deliberations, the Arbitration Panel awarded $250,000.00 to the Plaintiffs.
