Description of Case: Plaintiff was a 56-year-old woman with diabetes mellitus, hypertension, peripheral neuropathy and chronic foot ulcers. Plaintiff presented with complaints of persistent chills and fever lasting for three days accompanied with body aches, decreased appetite, peripheral neuropathy and sore throat. On August 5th, Plaintiff’s temperature was 102°. She had nausea and vomiting, dry heaves and threw up bile. Plaintiff’s husband was told that Plaintiff had a bug that would take time to resolve. On August 6th, Plaintiff’s husband again called ABC Health System to report that Plaintiff’s temperature was 102° and 103°. Plaintiff was seen on August 6th and diagnosed with gas gangrene. Plaintiff’s right leg was amputated four days later.
