Medical malpractice or invasion of privacy – or both? A recent lawsuit was filed by a patient that had her medical records sent without her consent. We all trust that our medical records will be maintained in a confidential manner and only disclosed with our permission for appropriate use. But what happens when the rules are not followed? Is it a basis for a lawsuit or just part of life? A recent lawsuit arose from an employee that lost 192 patient records on the subway. How would you feel if your private medical information was lost or disclosed without consent?
